Layaway Plan – Terms and Conditions

These Layaway Plan Terms and Conditions ("Terms") govern participation in the layaway program offered by Southern Garden Tools ("we," "us," or "our"). By placing an item on layaway, the customer ("you" or "customer") agrees to be bound by these Terms.

1. Eligibility and Items

1.1 Layaway is available only for eligible merchandise as determined by us. Certain items (including clearance, promotional, or special-order items) may be excluded.

1.2 All items placed on layaway remain the property of Southern Garden Tools until paid in full.

2. Deposit and Payment Schedule

2.1 Initial Deposit: A non-refundable deposit of [amount or percentage] of the total purchase price is required at the time the layaway is opened.

2.2 Payment Schedule: Payments must be made according to the agreed schedule: [weekly/biweekly/monthly] with acceptable payment amounts to take no more than 180 days.

2.3 Final Payment Due Date: The total balance must be paid in full within 180 days from the layaway start date.

2.4 Payments may be made via credit/debit card or check.

3. Fees and Charges

3.1 Layaway Fee: A layaway service fee of is charged and is not refundable.

3.2 Late Payment Fee: Late or missed payments may result in a late fee of per occurrence.

3.3 Storage/Handling Fees: If applicable, storage or handling fees may apply.

4. Cancellations, Defaults, and Forfeiture

4.1 Customer Cancellation: If you cancel the layaway, a 25% stocking will be charged.

4.2 Default: Failure to make payments as scheduled may result in cancellation of the layaway without notice.

4.3 Forfeiture: Upon cancellation or default a 25% restocking fee .

5. Price, Taxes, and Adjustments

5.1 The item price is locked in at the time of layaway.

5.2 Sales tax is calculated at the time of sale.

5.3 Promotions or discounts applied after the layaway start date do not apply.

6. Item Availability and Substitutions

6.1 Items are reserved for production at the duration of the layaway period.

6.2 If an item becomes unavailable due to circumstances beyond our control, we may offer a substitution, store credit, or refund of payments made, at our discretion.

7. Shipping

Items will be shipped only after full payment is received.

8. Returns and Exchanges

8.1 Items purchased through layaway are subject to our standard return and exchange policy.

9. Limitation of Liability

To the fullest extent permitted by law, Southern Garden Tools shall not be liable for indirect, incidental, or consequential damages arising from participation in the layaway plan.

10. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will apply to new layaway agreements and, where permitted by law, existing agreements with notice.
